Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are a legal agreement between you and MOBILEBYTESENSEI PVT LTD (“betterflo”, “we”, “us”, or “our”) governing your use of the betterflo application, its floating-mic overlay and accessibility service, its input method editor (IME) / keyboard, and any related software, updates, and documentation (together, the “App”). By installing, enabling, or using the App you agree to these Terms. If you do not agree, do not install or use the App.

If you use the App on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Eligibility

You must be able to form a binding contract under the laws of your jurisdiction to use the App. If you are a minor under the applicable law of your place of residence, you may use the App only with the involvement and consent of a parent or legal guardian.

3. The App and how it works

betterflo is a private, on-device by default voice dictation app for Android. By default it works through a floating mic that sits over any app and inserts your dictated text using an Accessibility Service; a full keyboard (IME) is available as an alternative for anyone who’d rather not grant that service. Speech recognition, voice activity detection, and text formatting run on your device using locally installed models. Audio and transcripts are processed on your device and are not sent to our servers as part of ordinary dictation. See our Privacy Policy for exactly what the Accessibility Service reads and why.

Some functions — such as downloading language or model bundles and checking for updates — require a network connection to third-party or our own distribution endpoints. Where a feature would send any content off your device, the App will make that clear at the point of use, and such features are opt-in.

Certain capabilities described in our documentation or marketing (for example, any cloud-assisted processing or model-improvement programme) are planned and not active in the current release. They will only operate if and when we ship them, with separate notice and controls, and they do not change the on-device-by-default behaviour of today’s App.

4. Licence to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own lawful use. Open-source components included in the App are licensed to you under their own licence terms; see our Open-Source Notice. Where an open-source or model licence conflicts with these Terms, that component’s licence governs that component.

5. Acceptable use

You agree not to, and not to attempt to or permit others to:

• use the App for any unlawful, harmful, fraudulent, or abusive purpose, or to produce content that is illegal, defamatory, harassing, or that infringes the rights of others;
• reverse engineer, decompile, or disassemble the App, except to the extent this restriction is prohibited by applicable law or permitted by an applicable open-source licence;
• circumvent, disable, or interfere with security, licensing, or access-control features;
• resell, sublicense, rent, or commercially redistribute the App except as expressly permitted;
• use the App to build a competing product by copying its non-open-source components; or
• use the App in a way that violates the terms of any third-party service, model licence, or network you access through it.

You are solely responsible for the content you dictate, generate, edit, or transmit using the App and for complying with the laws that apply to you.

6. Your content

The App is a tool for capturing and formatting your own text. As between you and us, you retain all rights in the content you create with the App. Because dictation is processed on-device by default, we do not collect or store the text of your dictation in the ordinary course of use. Any optional feature that would transmit content off your device is described in our Privacy Policy and is opt-in.

7. Plans and pricing

betterflo offers a free tier. We plan to offer a paid “Pro” tier with additional features.

Pricing to be announced. The features, availability, and price of any paid tier are not final and will be published before any charge applies. Nothing in these Terms obliges you to purchase anything, and no paid tier is active until we announce it. If and when a paid tier launches, applicable billing, renewal, and cancellation terms will be presented to you before you subscribe, and any purchase made through an app store is also subject to that store’s terms.

8. Updates and changes to the App

We may release updates, and may add, change, or remove features. We may also suspend or discontinue the App, in whole or in part, at any time. Where reasonably practicable we will give notice of material changes. Continued use after an update means you accept the updated App.

9. Third-party services and models

The App may download and run machine-learning models and use third-party distribution or network services. Those models and services are provided under their own licences and terms, and may carry their own restrictions. We are not responsible for third-party services, and your use of them is at your own risk and subject to their terms.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure, that defects will be corrected, or that speech recognition, transcription, or formatting will be accurate or suitable for any particular purpose. You are responsible for reviewing output before relying on it. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, betterflo and its contributors, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the App, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid us, if any, for the App in the twelve months before the event giving rise to the liability, or (b) one thousand Indian Rupees (INR 1,000).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

12. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless betterflo and its contributors from claims, damages, and reasonable expenses arising from your misuse of the App or your breach of these Terms or of applicable law.

13. Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate your access if you breach these Terms or use the App unlawfully. On termination, the licence in Section 4 ends; Sections 5, 6, and 10 through 15, and any terms that by their nature should survive, will survive.

14. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. MOBILEBYTESENSEI PVT LTD is incorporated in India. Subject to applicable law, the courts at Bengaluru, Karnataka, India, will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the App, and you consent to that jurisdiction and venue. If you use the App from outside India, you are responsible for compliance with your local laws; mandatory consumer-protection rights in your place of residence are not affected by this section.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date and, for material changes, provide reasonable notice. Your continued use of the App after changes take effect means you accept the revised Terms.
